# UGC creator contracts, usage rights and raw footage

## TL;DR
- **Never use creator content without a signed document.**[^1]
- Contract essentials: scope, deliverables, **usage period**, what the creator gets, deadlines, revisions, payment timing.[^1][^2]
- Usage language: **"paid advertising"**, not a list of platforms — keeps Meta/TikTok/YouTube all open.[^3]
- Ask for a **blanket 4-year license** on **raw, unedited** footage; renegotiate if still running at year 4.[^4][^5]
- Present the deal as **product value + fee** (a $200 product + $200 fee = a "$400 package").[^2]
- Timeline: **5-day production** — 4 days to film after the product arrives, 1 day reserved for revisions.[^2]
- Record a **walkthrough video** of brief, script, contract and payment process for each creator.[^6]

## Details
**Who.** [[people/melvin-cotton]] (Smart Marketer creative ops) with [[people/molly-pittman]], Aug 2026.

**Why raw footage.** Smart Marketer briefs creators as **talent only**: the team writes the concept, the creator films themselves with the product and sends unedited files, and in-house editors make the ads. One clip can become ~40 ad variations.[^6][^4] Pitch this to creators as *less* work — the slow parts of UGC are inventing the idea and editing; filming is quick, and they keep the product.[^7]

**Why 4 years, not unlimited.** Creators know raw footage is valuable. Melvin cites commercial/TV talent usage terms of ~5–6 years and meets "halfway" at 4 — long enough to test, recut and retest without rushing into 3-, 6- or 12-month windows.[^4] Molly: a few hundred dollars is cheap next to what a winning ad earns, so paying to extend at year 4 is fine.[^5] Track each license's end date and honor it.[^3]

**Reducing friction.** The walkthrough video answers questions before they're asked and builds trust — creators fear how their face will be edited and positioned; a likeable, consistent agency contact matters.[^6][^8]

## Disagreements / caveats
- Other operators ask for more: Boost App Social (app UGC ads, note `ugc-creator-mass-outreach-and-rights`) uses perpetual rights that transfer with the business — useful if you may sell the company; 4 years is Smart Marketer's fairness compromise.
- Not legal advice; the 4-year term is one agency's convention, not a standard. Check local law and union (SAG-AFTRA) rules if working with union talent.
- Organic-posting creator programs (see [[ugc-creator-onboarding-course]]) are structured around the creator's own account and views, so usage-rights terms differ.
